In September 2002 I started suing telemarketers who call me in violation of the TCPA. My motivation is to put a stop to the illegal calls. I pay Qwest to have my numbers unpublished, as well as for their Privacy Plus service. I have submitted my telephone numbers to the DMA's Telephone Preference Service. And now (6/27/2003) I have submitted my numbers for the FTC/FCC national "Do Not Call" registry. I receive very few live telemarketing calls, but I still receive far too many illegal pre-records.

[Prerecorded call from "TOLL FREE 866-499-7474" trying to get me to resubscribe with Sirius. This was not a violation since I was recently a customer. I had to press zero to talk to an operator; I requested to be put on their do-not-call list and receive a copy of their written do-not-call policy, which the operator told me that they do not have. I told her that it is legally required, and she put in the notes on my account that I am not to be called or emailed and that I have requested a DNC policy.]
[Prerecorded call from 44-207-490-6113 (probably spoofed caller ID) saying that they had been trying to reach me because my auto warranty is expiring and needs to be renewed. It told me to press one for an operator. Despite the UK number, the woman who spoke had an American accent and asked for the make and model of my car or truck. As soon as I asked to be put on the do-not-call list, she hung up on me. My cell phone number is not associated with either of our cars, so this whole call was apparently a scam to get people to sign up for auto warranties not associated with the original manufacturers or dealers. It may have been this script, which others have received: "Please listen carefully as this is an important notice regarding your automobile. We recently mailed you a postcard to activate your extended warranty coverage. This courtesy call is your final notice that your vehicle may be reclassified and the opportunity to activate your extended warranty coverage may expire. Activating this valuable coverage at deeply discounted rates is fast and easy. To speak with an agent regarding your options now, before the deadline, please stay on the line for a warranty specialist. If you have already extended your warranty coverage, or wish us to remove your information from our system, please press two. Transferring." A story about this scammers on MSNBC is here.]
[Prerecorded call from 866-526-9732 saying that I've won a no-catch vacation travel trip, all I have to do is leave my name and number and I'll be told where to pick it up. It hung up on me before I could leave a unique fake name and a real number, so I can identify who to sue.]

I pressed one and asked what company it was, and was told United Debt Aid. When I asked to be put on their do-not-call list, I was hung up on. This call was very similar to the Unknown Car Warranty call on January 30.]

I pressed one to speak to a live operator, who claimed he was with Dish Network and wouldn't give a more specific company name. When I pressed him further, he said he was with "Third Party Marketing." I asked to be put on their do-not-call list, and he agreed and then hung up before I could ask for a copy of their written do-not-call policy.]
